Welcome to Twinkie’s Coffee, LLC. These Terms & Conditions (the “Terms”) govern your access to and use of the Twinkie’s Coffee, LLC website, physical business locations, products, services, promotions, loyalty and rewards programs, gift cards, online features, and other offerings that reference or are subject to these Terms (collectively, this “Site and Services”). Throughout these Terms, “Twinkie’s Coffee,” “Company,” “we,” “us,” and “our” refer to Twinkie’s Coffee, LLC. The terms “you,” “your,” “customer,” and “User” refer to any individual who accesses or uses our Site and Services or purchases our products.
By accessing or using our Site and Services, participating in our programs or promotions, or purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. Twinkie’s Coffee is a Texas-based coffee and beverage business dedicated to providing customers with thoughtfully crafted beverages, quality products, and an enjoyable and welcoming customer experience. Our products and services may include coffee, tea, specialty beverages, food items, merchandise, promotional offers, loyalty and rewards programs, gift cards, online content, and other related products and services. Products, services, business hours, locations, pricing, promotions, and availability may change from time to time.
2. ELIGIBILITY
This Site is not intended for use by children under the age of 13. You must be at least 13 years of age to access or use this Site. If you are between the ages of 13 and 18, you may access and use this Site only with the permission and supervision of a parent or legal guardian who agrees to be bound by these Terms. However, actual products may vary from website photographs, promotional materials, social media content, or other representations due to differences in preparation, ingredients, availability, packaging, suppliers, equipment, displays, and other factors. All products and services are subject to availability. We reserve the right to modify, substitute, discontinue, limit, or refuse the sale of products and services at any time and as permitted by applicable law.
6. PRODUCT AVAILABILITY AND SUBSTITUTIONS
Certain products, ingredients, flavors, menu items, merchandise, and other offerings may be available only for a limited time, seasonally, while supplies last, or at participating locations. Twinkie’s Coffee does not guarantee the continued availability of any particular product or service. When reasonably necessary, ingredients or products may be substituted with comparable alternatives. We reserve the right to establish quantity limitations on products, promotions, discounts, and other offerings.
7. PRICING AND PAYMENT
All prices are stated in United States dollars unless otherwise indicated. Prices, products, taxes, fees, discounts, promotions, and availability may change without prior notice. You are responsible for reviewing all pricing and purchase information before completing a transaction. You agree to provide accurate, complete, and current payment information.
Twinkie’s Coffee reserves the right to refuse, cancel, or limit transactions when we reasonably suspect fraud, unauthorized activity, pricing errors, technical problems, promotion misuse, or other circumstances affecting the validity or security of a transaction. Applicable sales taxes and other charges required by law may be added to purchases.
8. ORDERS
Twinkie’s Coffee may offer in-person, advance, online, pickup, catering, or other ordering options. You are responsible for reviewing your order and ensuring that all information, including product selections, quantities, customizations, pickup details, and contact information, is accurate before submitting the order. Submitting an order does not guarantee acceptance.
We reserve the right to reject, modify, or cancel an order due to product availability, ingredient shortages, pricing errors, technical issues, suspected fraud, operational limitations, safety concerns, or circumstances beyond our reasonable control. If Twinkie’s Coffee cancels an order after payment has been processed, we will provide an appropriate refund or credit as required by applicable law.
9. ORDER PICKUP AND UNCLAIMED ORDERS
Customers are responsible for picking up orders within the applicable pickup timeframe. Twinkie’s Coffee is not responsible for changes in product temperature, freshness, appearance, or quality resulting from delayed pickup. Due to the perishable nature of our products, orders that are not picked up within a reasonable period may be discarded for food quality or safety reasons. Unless otherwise required by law or approved by Twinkie’s Coffee, refunds may not be provided for orders that are prepared correctly but are not picked up by the customer.
10. CANCELLATIONS, REFUNDS, AND RETURNS
Due to the perishable, consumable, and customized nature of many products sold by Twinkie’s Coffee, food and beverage purchases are generally final and non-refundable unless otherwise required by applicable law. If you experience a problem with your order or purchase, please contact Twinkie’s Coffee as soon as reasonably possible. We may request information concerning the transaction and the nature of the issue before providing a resolution. Depending on the circumstances, we may provide a replacement, refund, store credit, or other appropriate resolution at our discretion and as permitted by applicable law. Merchandise returns or exchanges, if offered, may be subject to separate requirements communicated at the time of purchase.
11. FOOD ALLERGIES AND CROSS-CONTACT
Products prepared, handled, stored, served, or sold by Twinkie’s Coffee may contain or come into contact with common allergens. These allergens may include, but are not limited to, milk, dairy products, eggs, wheat, gluten, soy, peanuts, tree nuts, and other ingredients. Our products may be prepared using shared equipment, utensils, preparation areas, storage areas, or facilities. Although we strive to provide accurate ingredient information and respond appropriately to customer questions, Twinkie’s Coffee cannot guarantee that any product is completely free from allergens or the possibility of cross-contact.
Customers with food allergies, sensitivities, dietary restrictions, or other concerns are responsible for informing our staff before placing an order and determining whether a product is appropriate for their individual needs. Ingredients, recipes, suppliers, and product formulations may change without prior notice.
12. CAFFEINE, INGREDIENTS, AND CONSUMPTION
Certain products sold by Twinkie’s Coffee may contain caffeine, sugar, dairy products, alternative milk products, or other ingredients that may affect individuals differently. Customers are responsible for making purchasing and consumption decisions appropriate for their individual needs, preferences, sensitivities, and dietary considerations. Information provided by Twinkie’s Coffee concerning products and ingredients is for general informational purposes only and is not intended to constitute medical, nutritional, dietary, or other professional advice.
13. PRODUCT CUSTOMIZATIONS
Twinkie’s Coffee may allow customers to customize certain beverages and products. We make reasonable efforts to prepare customized orders according to customer requests. However, we cannot guarantee that every customization request can be accommodated. Additional charges may apply to substitutions, additions, alternative ingredients, specialty products, or other customizations. Product customization does not guarantee that a product will be free from allergens or cross-contact.
14. PROMOTIONS, DISCOUNTS, AND “WHAT’S BREWING” OFFERS
Twinkie’s Coffee may offer promotions, discounts, coupons, promotional codes, special events, limited-time offers, or other incentives, including offers featured through our “What’s Brewing” webpage or promotional materials. Unless otherwise stated by Twinkie’s Coffee, promotions:
Have no cash value;
May not be sold or transferred;
May not be combined with other discounts or offers;
May be limited to certain products, customers, locations, dates, or quantities;
Are available while supplies last, when applicable; and
Expire according to the terms of the applicable promotion.
Additional terms and restrictions may apply to individual promotions. Twinkie’s Coffee, LLC reserves the right to modify, suspend, cancel, limit, or refuse a promotion due to errors, fraud, misuse, abuse, technical problems, or other circumstances permitted by applicable law.
15. MILITARY, FIRST RESPONDER, AND OTHER COMMUNITY DISCOUNTS
Twinkie’s Coffee may offer discounts to eligible members of the military, veterans, first responders, healthcare professionals, or other designated groups. Eligibility requirements, identification requirements, discount amounts, participating products, and other restrictions may apply. Discounts are intended solely for eligible individuals and may not be transferred to others. Unless otherwise stated, community discounts may not be combined with other promotions, coupons, discounts, or special offers. Twinkie’s Coffee reserves the right to modify or discontinue discount programs as permitted by applicable law.
16. LOYALTY AND REWARDS PROGRAMS
Twinkie’s Coffee may offer loyalty cards, punch cards, rewards programs, memberships, points, discounts, complimentary products, or other customer appreciation programs. Participation may be subject to additional terms and requirements. Unless otherwise stated, rewards:
Have no cash value;
May not be sold, transferred, or exchanged;
May not be combined with other promotions;
May be limited to certain products or services; and
May expire according to applicable program terms.
Lost, stolen, damaged, altered, or destroyed physical loyalty cards may not be replaced. Fraudulent use, duplication, manipulation, unauthorized transfer, or abuse of a loyalty or rewards program may result in cancellation of rewards and termination of participation. Twinkie’s Coffee reserves the right to modify, suspend, or discontinue loyalty and rewards programs as permitted by applicable law.
17. GIFT CARDS
Twinkie’s Coffee may offer physical or electronic gift cards. Gift cards may be subject to additional terms provided at the time of purchase. Gift cards are not redeemable for cash except where required by applicable law. Customers are responsible for safeguarding physical and electronic gift cards. Twinkie’s Coffee is not responsible for lost, stolen, damaged, or unauthorized use of gift cards except as required by applicable law. We reserve the right to refuse, suspend, or cancel gift cards reasonably suspected of being obtained or used fraudulently.
18. BUSINESS HOURS, CLOSURES, AND SERVICE INTERRUPTIONS
Business hours and operating schedules may change. Twinkie’s Coffee reserves the right to temporarily modify business hours, close a location, limit services, or suspend operations due to severe weather, emergencies, staffing limitations, equipment problems, maintenance, supply shortages, safety concerns, private events, government requirements, or other circumstances. We will make reasonable efforts to communicate significant changes when appropriate but cannot guarantee advance notice.
19. CUSTOMER CONDUCT AND RIGHT TO REFUSE SERVICE
Twinkie’s Coffee is committed to providing a welcoming, respectful, and safe environment for customers, employees, contractors, vendors, business partners, and guests. Threatening, violent, abusive, harassing, discriminatory, fraudulent, intentionally disruptive, destructive, or unlawful conduct will not be tolerated.
To the extent permitted by applicable law, Twinkie’s Coffee, LLC reserves the right to refuse service, discontinue a transaction, require an individual to leave the premises, restrict future service, contact law enforcement, or take other reasonable action when conduct creates a safety concern, threatens or harasses others, damages property, disrupts business operations, involves suspected fraud or theft, or violates applicable law. Nothing in this provision permits discrimination or refusal of service in violation of federal, state, or local law.
20. PHOTOGRAPHY, VIDEO, AND SOCIAL MEDIA AT OUR LOCATIONS
Customers may take personal photographs and videos at Twinkie’s Coffee locations provided that doing so does not disrupt business operations, interfere with employees or other customers, create a safety concern, violate another person’s privacy, or involve unauthorized commercial activity. Professional or commercial photography, videography, interviews, content creation, or organized photo sessions may require prior written permission from Twinkie’s Coffee. We reserve the right to restrict photography or recording when reasonably necessary to protect customer privacy, employee privacy, safety, business operations, or Company interests.
21. WEBSITE INFORMATION AND ACCURACY
Twinkie’s Coffee makes reasonable efforts to provide accurate, complete, and current information through our Site. However, we do not guarantee that all information will always be accurate, complete, current, or free from typographical, technical, or other errors. Information regarding products, prices, promotions, business hours, locations, ingredients, availability, and services may change without prior notice. We reserve the right to correct errors, inaccuracies, and omissions and update information at any time.
22. WEBSITE AVAILABILITY
Twinkie’s Coffee does not guarantee that our Site or online services will always be available, uninterrupted, secure, or error-free. Access may be restricted or unavailable due to maintenance, updates, technical problems, cybersecurity concerns, internet interruptions, third-party service disruptions, or circumstances beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any portion of our Site or online services at any time.

These third-party services are provided for convenience and are not controlled by Twinkie’s Coffee. This Site and its content, including but not limited to the Twinkie’s Coffee name, logos, trademarks, slogans, photographs, graphics, designs, text, product names, menu names, written materials, blog content, promotional materials, website content, and other original content, are owned by or licensed to Twinkie’s Coffee unless otherwise stated. This content is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, publish, display, sell, license, commercially exploit, or otherwise use our intellectual property without prior written authorization. Unauthorized use of our intellectual property may result in legal action.
25. CUSTOMER CONTENT, REVIEWS, AND FEEDBACK
Customers may voluntarily submit reviews, comments, photographs, feedback, suggestions, social media content, or other materials relating to Twinkie’s Coffee. By submitting content directly to Twinkie’s Coffee, you represent that you have the legal right to provide the content and that it does not violate applicable law or infringe another person’s intellectual property, privacy, publicity, or other legal rights. Twinkie’s Coffee is not obligated to compensate individuals for voluntarily submitted ideas, suggestions, or feedback unless otherwise agreed to in writing. Marketing communications will be sent in accordance with applicable law. You may unsubscribe from promotional emails by following the unsubscribe instructions provided in the applicable communication. Should Twinkie’s Coffee offer text message communications in the future, participation will be voluntary and may be subject to additional terms. Message frequency may vary, and message and data rates may apply. Customers may withdraw consent from marketing text communications using the opt-out instructions provided through the applicable program. Consent to receive marketing text messages will not be a condition of making a purchase unless otherwise permitted by applicable law.
29. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE, SERVICES, PRODUCTS, AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TWINKIE’S COFFEE DOES NOT GUARANTEE THAT OUR SITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TWINKIE’S COFFEE DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS LIMITS OR EXCLUDES WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE WAIVED OR EXCLUDED.
30. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TWINKIE’S COFFEE AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF OUR SITE, SERVICES, PRODUCTS, OR CONTENT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF TWINKIE’S COFFEE FOR ANY CLAIM ARISING FROM A PURCHASE SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
31. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Twinkie’s Coffee and its owners, members, managers, employees, contractors, agents, and representatives from and against claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of our Site or Services, violation of these Terms, or infringement of another party’s legal rights.
32. FORCE MAJEURE
Twinkie’s Coffee shall not be responsible for delays, interruptions, closures, shortages, cancellations, or failures to perform caused by circumstances beyond our reasonable control. These circumstances may include severe weather, natural disasters, fires, floods, power outages, equipment failures, supply chain disruptions, labor shortages, government actions, public health emergencies, civil unrest, transportation interruptions, internet outages, or failures of third-party service providers.
33. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms, our Site, Services, products, or your relationship with Twinkie’s Coffee shall be handled in accordance with applicable law.
34. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
35. NO WAIVER
The failure of Twinkie’s Coffee to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be expressly provided in writing by an authorized representative of Twinkie’s Coffee.
36. CHANGES TO THESE TERMS & CONDITIONS
Twinkie’s Coffee reserves the right to modify, revise, or update these Terms from time to time. When changes are made, the “Last Updated” date at the end of these Terms will be revised. Unless otherwise required by applicable law, updated Terms will become effective when posted on our Site. Your continued use of our Site and Services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law. We encourage you to periodically review these Terms for updates.
37. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any additional terms or policies applicable to specific products, services, promotions, loyalty programs, gift cards, or other offerings, constitute the entire agreement between you and Twinkie’s Coffee regarding your use of our Site and Services.
